In the volume ‘The Dynamics of Powers in the European Union’ edited by Christina Eckes, Päivi Leino-Sandberg & Anna W Ghavanini, published on 19 September 2024, BEDER member prof. Merijn Chamon (VUB) contributed a chapter dedicated to ‘Regulatory Cooperation Chapters as Fuzzy Law’. The chapter looks into the implication of regulatory cooperation chapters in the EU’s deep and comprehensive free trade agreements for the EU’s separation of powers, finding that these chapters constitute ‘fuzzy law’ since they leave unbounded discretion to the executive while leveraging an internal executive-driven deregulatory agenda to the international plane, insulating it from domestic contestation.
